My tenant left behind personal belongings?
I rented to the same man for the last three years. Him and his girlfriend were moving out and the last day of his lease was February 28,2009. He called me the evening of the 28th saying he needed a few more days. I told him that was fine and I would prorate the days and take it out of his $500.00 deductible. He said that was fine too. He also stated he was cleaning the unit and also having the carpet steam cleaned as he had done some damage to it.
I stopped by this morning and there are still personal belongings left in the unit? No furniture – just boxes. His girlfriend sent me a text message saying it was all trash other than the dishes.
This condo is in Denver, Colorado. What rights do I have in order to get this place ready for somebody else to move in? I would like to get his stuff out and change the locks as I do between each tenant.
Every state has abandoned property laws that dictate how many days you must leave it before you can do anything. You will have to check the # of days required for CO.
You will have to send a notice stating that the items need to be removed in x # of days or they will be disposed of. You then must wait the legally required # of days. You can then sell anything worth anything and apply that to any money owed.
Make sure to list, document and take pictures of everything even if it looks like trash. You would be surprised what people will fight for!
